UFBU MEETING HELD ON 13-11-2017

UFBU meeting was held in Mumbai in AIBEA Office on 13-11-2017. Com.K.K. Nair, Chairman of UFBU presided over the meeting.

1.Increasing attacks on banking sector: The meeting conveyed its appreciation to all units and members for the massive participation in the Morcha to Parliament programme on 15-9-2017. The meeting noted that Government is planning to further go ahead with their banking reform measures and hence decided that our campaign and struggle should be continued and intensified. While reiterating the decision to launch strike actions if the Government would take any adverse decisions, the meeting decided that State-level campaign should be undertaken to explain all these attacks to our grass-root level members and also to the general public. It was also decided to undertake mass signature campaign for submitting the Petition to Speaker of the Lok Sabha. Details of this programme along with the copy of the Petition will be sent to units shortly.

2. Wage Revision: The meeting took note of the details of the discussions held so far by the IBA with the Workman Unions/Officers Associations. The meeting noted that while some rounds of discussions have taken place on non-financial demands, the IBA was yet to come out to make their initial offer although it is six months since the formal negotiations have begun. Hence it was decided to take up the matter with IBA to immediately hold the meeting of the Negotiating Committee and to make their offer. It was also decided that UFBU representatives shall meet the top management of the Banks who have given restricted mandate for officers to the IBA.

3. Extend support to Two Days Strike in Regional Rural Banks: United Forum of RRB Unions has given a call for two days strike on 11th and 12th December, 2017 on their demands like opposition to privatization of RRBs, extension of PF-Pension Parity for RRB employees and officers, compassionate ground appointments, parity in service conditions at par with sponsor banks, etc. It was decided to extend our support to their strike and their demands as follows:
i. UFBU to address a letter a Finance Minister
ii. Constituent unions to address letter to Finance Minister
iii. Our members to participate in their demonstrations on 11th and 12th December on the strike days.

4. Support to AIBEA-AIBOA Strike on 27th December, 2017: The meeting decided to extend fraternal support to the call given by AIBEA and AIBOA for All India Strike on 27th December, 2017 demanding immediate wage revision for IDBI Bank employees and officers.

UFBU’s LETTER TO CHAIRMAN, IBA

“ You are well aware that on the Charter of Demands submitted by our Employees Unions and Officers Associations, discussions have commenced from May, 2017 and quite a few rounds of discussions have also taken place. Right from the beginning IBA has been expressing that the entire discussions need to be concluded at the earliest, preferably before Diwali festival so that the revised pay scales can be implemented from 1-11-2017. Department of Financial Services, Ministry of Finance, Government of India have also been issuing frequent communications that the negotiations are to be completed well in time before 1-11-2017.

2. But it is observed that while discussions are taking place on non-financial demands, so far IBA has not made any offer on increase in wages. You will appreciate that increase in wages is the crux
of the Charter of Demands submitted by us and IBA’s silence on this important issue, is a matter of serious concern to all of us.

3. While reiterating our commitment to conclude the discussions early and expedite the Settlement through mutual discussions, we wish to point out that expeditious Settlement is not possible if IBA does not come forward to make their offer on quantum of wage increase and negotiate the same to the satisfaction of all to conclude the Settlement without any further delay.

4. IBA’s reluctance or delay in making the offer on wage revision for the past six months is creating resentment and restlessness among the rank and file of employees and officers and hence it is not desirable to delay it any further. As already requested in the last round of meeting, we urge upon IBA to convene the meeting of the Negotiating Committee immediately, make their initial offer and conclude the settlement expeditiously so that the whole process of wage revision settlement for employees and officers is completed. Looking forward to your positive response ”

DISCUSSIONS WITH IBA ON 14.11.2017

One more round of discussions took place between IBA and our Workmen Unions yesterday i.e.14.11.2017 in IBA Office ain Mumbai.

IBA’s Sub-Committee was represented by Mr. Rakesh Sharma (MD, Canara Bank and Chairman of the Sub-Committee), Mr. V.G. Kannan(Chief Executive, IBA), Mr. B. Raj Kumar(Dy. Chief Executive, IBA), Mr. M.K Gupta(GM, Bank of India), Mr. Punit Jain(GM, PNB), Mr. T.S Seshadri(GM, Indian Bank), Mr. S.K Kakkar(Sr. Advisor, HR&IR, IBA) and Mr. K.S Chauhan(Advisor, IBA).

Our team was represented by Com. C.H. Venkatachalam and Com. B.S. Rambabu(AIBEA), Com. S.K Bandlish and Com. Vinil Saxena(NCBE), Com. Pradip Biswas(BEFI), Com. Subhash Sawant(INBEF) and Com. Upendrakumar(NOBW),

During the meeting, the following issues discussed in the meeting held on 3.11.2017 in the Sub-Group on demands relating to Disciplinary Action and Procedure were informed and further discussion took place.

i. For claiming travelling expenses for defending an employee in the departmental action, existing restrictions of ‘within the state’ be removed.

ii. Subsistence Allowance to be improved upon.

iii. Indiscriminate usage of Clause 5(j) to be stopped through proper guidelines / definition.

iv. Clarification with regard to provision of Clause 6(e) i.e. bringing down by two stages in the scale of pay and applicability of the same to employees who have already reached maximum in the scale of pay.

v. Clarification to be given that minor misconducts clearly enumerated under Clause 7 of BPS dated 10.04.2002 should not be brought as major misconducted under Clause 5.

vi. Multiple charges for one incident should not be made out.

vii. Punishment order by the Disciplinary Authority not to be implemented till the final disposal of Appeal by the Appellate Authority.

viii. Issuance of charge sheet under Pension Regulation to Award Staff after retirement to be stopped since it is not provided in Bipartite Settlement.

ix. Awarding the punishment of stoppage of increments should be without affecting superannuation benefits, as in the case of Officers.

x. Provision for appeal against suspension.

xi. In case of punishment of dismissals, a provision for Review Authority after Appellate Authority.

xii. Deletion of Fine as a punishment.

It was decided that the conclusions on the discussion on these issues would be finalised in the next meeting.

Thereafter, the following issues were taken up for discussions:

– Simplified formula for calculation of overtime wages. Unions submitted their views and the issue would be discussed further.

– On the issue of introduction of Leave Bank providing for voluntary contribution of leave by the employees to a common pool and utilisation of the same for sanctioning leave to those employees who suffer from major diseases and prolonged illness and have not leave to their credit, Unions submitted their Note containing their views and explained their proposal. It was decided to discuss the issue further.

– On our demands like Child Care Leave for women employees, Sabbatical Leave, Study Leave, etc., it was agreed that Unions would submit a Note for further discussion.

We pointed out that considerable time has elapsed since commencement of the discussions in May, 2017 on our Charter of Demands, but so far IBA has not come forward with their offer on wage increase and hence demanded that the next meeting of the Full Negotiating Committee should be fixed up at the very earliest for this purpose.

Dear Sirs,

Dearness Allowance for Workmen and Officer Employees in banks for the months of November. 2017 2018 under X BPS/ Joint Note dated 25.5.2915

The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Basel 960=100) for the quarter ended September 2017 are as follows:-

July 2017 : 6505.38

Aug 2017 : 6505.38

Sep 2017 : 6505.38

The average CPI of the above is 6505 and accordingly the number of DA slabs are 5 16(6505- 4440= 2065/4= 516 Slabs) The last quarterly Payment of DA was at 478 Slabs. Hence there is an increase in DA slabs of 38, i.e 516 Slabs for payment of DA for the quarter Nov, Dec 2017 and January 2018.

In terms of clause 7 of the IOU’ Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance payable to workmen and officer employees for the months of Nov, Dec 2017 & January 2018 shall be 51.60 % of ‘pay’. While arriving at dearness allowance payable, decimals from third place may please be ignored.

We advise banks to pay the difference between the old and revised salary and allowance to officers on an ad hoc basis, pending amendments to Officers’ Service Regulations.

Demonestisation killed 1.5 million jobs
Hold demonstration in all State Capitals

Demonestisation of currency notes of Rs. 1000 and Rs. 500 was announced on 8th November 2016 and one year is goint to be completed on 7th November next after the announcement made by the Hon’ble Prime Minister going beyond the provisions of Reserve Bank of India Act.

The annual report published by Reserve Bank of India recently reveals that Rs. 15.28 lakhs crores or 99% of Rs. 15.44 lakhs crores scrapped currency notes came back to the system after demonetization. The annual report also stated that only Rs. 16000 crores of demonetised currency was not deposited with the banks.

While announcing demonetization, Govt. boasted it as a fight against black money, funding for terrorists and counterfeit currency but all have fallen flat, With the 99% of currency notes exchanged legally, the question arises, was the demonetization a scheme designed to convert black money into white.

Demonetisation has claimed lives of more than 100 innocent citizen of our country including more than 10 bank employees and officers. The Government is solely responsible for this loss of lives. But the irony of the thing is that the Central Cabinet in a Press communique stated that there has not been any loss of live due to demonetisation.

The claims pronounced at the time of demonetization having been proved to be a hoax and to divert the attention of the common people from the ill effects of demonetization, the Government has taken the move for digitization of the payment system in the interest of fintech companies like Paytm, jio money etc. Such step will have disastrous effect on our banking system.
As per survey report made by Centre for Monitoring Indian Economy (CMIE) demonetization has killed more than 1.5 million jobs.

Centering round demonetization we organised several programs in the last year. In the backdrop of Government’s move to divert the attention of the people from the damage caused to our economy and the interest of the common people particularly the workface in the informal sector, we feel it duty bound to raise our voice of protest once again against the ill effects of demonetization.

As decided in our last Central Committee meeting held in Delhi, we call upon our units to organise protest demonstrations/rallies/meetings in all State capitals and major centres on a day falling between 8th November to 15th November 2017 as per local convenience.

SBI revises service charges on maintaining monthly average balance

SBI revises service charges on maintaining monthly average balance

Mumbai, September 25, 2017: State Bank of India (SBI) has reviewed the requirement of maintaining Monthly Average Balance (MAB) and the charges for non-maintenance of MAB. In this context SBI would like to state that financial inclusion including JAN DHAN Accounts have never been subject to any charges. In respect of the rest, it has now been decided to exempt the pensioners, beneficiaries of social benefits from the Government and accounts of Minors. Therefore, this is in addition to the already exempted categories under PMJDY accounts and Basic Savings Bank Deposits Accounts (BSBD).

The Bank has also decided to treat the metro and urban centres in the same category and the requirement of MAB in metro centres stands reduced to Rs.3000/- . For non-maintenance of MAB, the charges have also been revised downward ranging from 20% to 50% across all population groups and categories. The charges at semi-urban and rural centres range from Rs.20/- to Rs 40/- and at urban and metro centres from Rs 30/- to Rs 50/-. The revised MAB requirement and charges will become applicable from the month of October 2017.

The Bank has a very strong deposit franchise having 42 crores Savings Bank accounts out of which 13 crore accounts under PMJDY / BSBD were already exempted. The above revision is likely to benefit another 5 crore account holders. The Bank also clarified that customer always has the option of converting the regular savings bank account to BSBD account, free of charge, in case he desires to avail basic savings bank facilities without being subject to maintain MAB. The features of BSBD accounts are available in the bank’s website bank.sbi.

The following categories of Savings Bank Accounts are excluded from MAB requirement:
i) Financial Inclusion Accounts
ii) Basic Savings Bank Deposit Accounts
iii) Small Accounts
iv) Pehla Kadam and Pehli Udaan accounts.
v) Minors up to the age group of 18 (Primary Account Holder)
vi) Pensioners, all categories, including recipients of social welfare benefits

This is further to our Circular No.23/2017 of yesterday. You were informed of the decision of Central Cabinet meeting held yesterday to constitute “alternative mechanism” for giving in principle approval for merger of public sector banks in the name of consolidation.

Through our circular referred above we expressed our strong sense of resentment against the decision of the Central Cabinet as we are of the firm opinion that the decision of the Cabinet is nothing but a ploy to go ahead with the hidden agenda of privatisation of public sector banks.

UFBU, through telephonic consultations among the constituents, has decided to hold demonstrations at all State Capitals and major centres at the earliest, the date for which will be decided by state units of UFBU depending upon local convenience.

We call upon all our units to take immediate initiative for holding meetings/consultations of/with state units/constituents of UFBU and to decide the date for holding the demonstration at State Capitals and all major centres of concerned States.

All our State units have to ensure maximum mobilisation of our members in respective areas.

Reg: Staff – Payment of Bonus – As per Bonus (Amendment), Act 2015. For the Year 2016-17.

Payment of Bonus Act was amended recently. As per the amended provisions the ceiling on salary and wage has been increased from Rs.10000/- to Rs.21000/- per month. As such, employees whose salary/wage does not exceed Rs.21000/- per month are now eligible for bonus.

It has been decided to pay Bonus at the rate of 8.33% of salary to all the eligible employees for the period 01.04.2016 to 31.03.2017.

Salary for this purpose includes 1) Basic pay (including FPP & PQP) 2) Special Pay 3) Dearness Allowance 4) Special Allowance with DA only.

All the branches / offices may note to disburse the Bonus to all the eligible employees as per the procedure given here under:

Tentative list of eligible employees together with Bonus Calculation as per the data extracted from HRMS shall be provided to all Zones.

Zonal Offices should get the data verified and confirm the correctness of eligibility and amount of Bonus paid and payable.

For any modifications required to be undertaken in the list, Zonal Office should submit the details to HO with suitable justification

On receipt of the “Branch-wise difference and addition of Bonus payable details – as per the format given in Annexure-IV” from the Zonal offices, the Bonus Amount will be credited to the “Cheque Proceeds Account” of the Zonal Office for onward distribution to branches.

Branches should enter details of Bonus paid in the Bonus Register for verification by the Labour Department Officials.

The entire exercise of verification of calculation and Payment of Bonus to eligible employees should be completed by 25.09.2017.

For the information of our branches/offices, the important guidelines and illustrations are given in Annexure-I, II and III

All the salary disbursing authorities are advised to go through the contents of this circular carefully and adhere to the stipulations mentioned without any deviation.

Launch of work from home facility by SBI

Launch of work from home facility by SBI

State Bank of India (SBI) has informed that it has introduced ‘Work from Home Policy’ for permanent Officers in the Bank. The details of the Policy are annexed.

(i) The facility can be availed occasionally up to 5 days a month or for a longer duration, subject to approval by the Competent Authority not less than officers in the grade of TEGS-VI i.e. Deputy General Manager/TEGSS-I i.e. Chief General Manager.

(ii) Job profiles covered have clear defined deliverables, which can be remotely measured and which requires minimal dependency of the job- on physical presence, on data/documents/system/infrastructure of the Bank, on vendor interaction, on daily co-ordination with team members, daily face to face meetings and regular face to face customer interactions.

(iii) Specific metrics are put in place for measurement of productivity of the officials along with addressing the security concerns on the Banks’ confidential data and information.

(iv) Job profile requiring access to the Core Banking Solution or facing customer on regular basis are not be covered under the policy.

(v) The employee is required to submit a work report based on the tasks/deliverables assigned and the respective completion status at the end of the Work from Home duration. The approver reviews the work of the employee before providing the confirmation on the work of the employee.

(vi) Employees are not be entitled for any allowance/benefits/compensation on account of Work from Home.

The above information given by the Minister of State in the Ministry of Finance Shri Santosh Kumar Gangwar in a written reply to a question in Rajya Sabha on 08.08.2017.
