This is in reference to DoP&T OM F. No. 35034/3/2015-Estt.(D) dated 27/28.09.2016 regarding enhancement of Benchmark for financial up‑gradation under MACP Scheme as per recommendations of the 7th CPC accepted by the Government.

Of late, field units have been seeking clarification regarding the applicability of benchmark ‘Very Good’ for considering financial up-gradation under MACP Scheme. The matter has been examined at FHQ and the following clarifications are issued for compliance by all concerned:-

(i) For grant of financial up-gradation under the MACPS, the prescribed benchmark would he ‘Very Good’ for all the posts w.e.f. 25.07.2016.

(ii) APAR grading ‘Good’ for the period prior to 25.07.2016 i.e. the date from which the new Benchmark made applicable, may be treated as ‘Very Good’ while considering such cases by the Screening Committee/BOO.

(iii) There should be at least three ‘Very Good’ grading and other two not below ‘Good’ grading out of last five ACRs/APARs considering point (i) & (ii) in view for arriving at the prescribed Benchmark ‘Very Good’. Some illustrations are given in the enclosed Annexure-A for guidance.

7th Pay Commission Benefits to Teachers and Academic Staff of Technical Institutes

Payment of Arrears (from 1.1.2016) on account of 7th CPC implementation

The government has approved a proposal to extend the 7th Central Pay Commission benefits to teachers and other academic staff of the state government and government-aided degree level technical institutes.

Shri Javadekar informed that the Government has approved proposal to extend the 7th CPC to the teachers and other academic staff of the State Govt. / Govt. aided degree level technical institutions in the country, which will have additional Central Government liability of Rs.1241.78 crore. He said that the Central Government will reimburse 50% of the total additional expenditure (from 1.1.2016 to 31.3.2019) to be incurred by these institutes for payment of arrears on account of 7th CPC implementation.

This will directly benefit a total of 29,264 teachers and other academic staff of State Government funded institutes. Besides, about 3.5 lakh teachers and other academic staff of private colleges/ institutions within the purview of AICTE will also benefit from the approval given today, he added.

This will have additional Central government liability of over 1240 crore rupees. The Centre will reimburse 50 per cent of the total additional expenditure from 1st January 2016 to 31st March this year to be incurred by these institutes for payment of arrears.

An official release said, the measure will directly benefit more than 29 thousand teachers and other academic staff of state government funded colleges and institutes.

Besides, about three-and-a-half lakh teachers and academic staff of private institutes under the AICTE will also benefit. Implementation of pay commission recommendation in State Government Aided / funded AICTE approved technical institutes will help them in attracting and retaining the faculty of high academic standards.

Railway recruit 13487 Engineers, Superintendent and Assistant in the pay scale of Rs 35,400- 112400/- (Level 6) as per 7th CPC

Ministry of Railways announces recruitment for 13487 posts of Junior Engineers (JE), Junior Engineers (IT), Depot Material Superintendent (DMS) & Chemical & Metallurgical Assistant (CMA)

The last date for applications for this 2 stage recruitment (1st stage- CBT, 2nd stage- Document Verification) is 31st January, 2019

Ministry of Railways has announced recruitment for 13487 posts of Junior Engineers (JE), Junior Engineers (Information Technology), Depot Material Superintendent (DMS) & Chemical & Metallurgical Assistant (CMA). The scale of the posts is Rs 35,400- 112400/- (Level 6) as per 7th CPC. The notification for the posts has been issued on the Railway Recruitment Board (RRB) website. The last date for applications for this 2 stage recruitment (1st stage- CBT, 2nd stage- Document Verification) is 31st January, 2019.

It is also to be noted that the notified 13487 vacancies are spread over different Railway Zones and States and candidates from all over India may apply against these pan India vacancies.

The qualifications to apply for Junior Engineers posts are three years Diploma in specified Disciplines or combination of various streams of the basic Engineering disciplines from a recognised Institution. For Depot Store Superintendent, three years Diploma in Engineering in any discipline from a recognized University/Institute. Degree in Engineering disciplines will also be acceptable in lieu of Diploma in Engineering. For Junior Engineer (IT), PGDCA/B.Sc. (Computer Science)/B.Tech (Computer Science)/DOEACC ‘B’ level course of three years duration or equivalent from recognised University/Institute is required qualifications for application. For Chemical & Metallurgical Assistant, Bachelor’s Degree in Science with Physics & Chemistry with minimum of 45% marks from a recognised University/Institute is required qualification for application. The medical standards for various posts are A3, B1, B2, C1. Age criteria is 18-33 years (as on 01.01.2019)

Ref: (i) NFIR’s PNM Item No.l/2011.
(ii) Action Taken Statement provided to NFIR during its PNM meeting held with the Railway Board 10/11-05-2018

The subject was discussed in a separate meeting held between the NFIR and Railway Board on l6/10/2017. During discussions, the Official Side conveyed that reply from DoP&T has been received and shared with the Federation. The Official Side further stated that the DoP&T has not agreed to the proposal. Responding to the version of Official Side, NFIR insisted that such of the staff who have completed more than two decades from the date of first promotion and stagnated, should be granted 3rd financial upgradation straightaway under MACPS and requested the Railway Board to make another reference to DoP&T for which suitable examples will be made available by the Federation for referring the matter again to DoP&T.

In this connection, Federation furnishes below a few cases of employees as to enable the Railway Board to apprise to the DoP&T, the cases of no promotion for over two decades.

RWF, Yelahanka:

l. Shri M.N. Indrashekar, appointed as Jr. CMA on 26/07/1983 – regularized on 26/07/1984 in GP 4200/-. He was promoted to GP 4600 on 20th May, 1986 (1st promotion) – granted financial upgradation with GP 4800/- on 01/09/2008 instead allowing 3rd financial upgradation with GP 5400 (PB-2) in view of no promotion for over 2 decades.

  1. Shri K.S. Dutta Shivrama, appointed as CMA on l8/11/1985 in GP 4200/-, promoted to GP 4600/- on l8-11-1986 – granted financial upgradation in GP 4800/- on 01/09/2008 instead allowing GP 5400, having stagnated for over 2 decades.
  2. Shri R.P. Suresh Kumar appointed as CMA on 19/12/1985 in GP 4200, promoted to GP 4600/- on 28-02-1989 granted financial upgradation in GP 4800/- on 0l/09/2008.

South Central Railway:

  1. Shri Kamal Kumar Kuley, appointed a CMA in GP 4200/- on 18/12/1983, and got promoted to GP 4600/- on 0l/01/1984, granted financial upgradation in GP 4800/- on 01/09/2008 instead granting GP 5400 due to stagnation for over 2 decades from the date of first promotion.
  2. Shri Amulya Kumar Dhali, appointed as CMA on 31/12/1982 in GP 4200/-, promoted to GP 4600/- on 01/01/1984 and got MACP in GP 4800/- on 0l/09/2008 instead GP 5400, for having stagnated for more than 20 years from the date of promotion.

Federation believes that above illustrations are sufficient to justify the demand for grant of MACP benefit to the staff in GP 5400/- as the staff suffered without promotion for over two decades and also to all similarly situated staff who have been in the same Grade Pay for more than two decades. A copy of the reference made to the DoP&T may be made available to the Federation for takine further action.

MILITARY SERVICE PAY

In a written reply to a question regarding Military Service Pay in Parliament on 26.12.2018, the Minister of State for Defence Shri Subhash Bhamre said that the MSP was raised by the identical fitment of 2.57.

We reproduced the answer and given below for your information…

“Taking note of the rigours of military life, the VI Central Pay Commission (CPC) had recommended an additional, separate element of pay for the Defence Forces called Military Service Pay (MSP), which the CPC intended would also maintain the edge enjoyed by the Defence Forces over the civilian scales.

The VII CPC has consciously decided not to create additional categories of personnel for the grant of MSP or to disturb the slab rates for the four categories for which it is being paid up to the level of Brigadiers. This was done after considering the views of the Services in the matter. MSP was raised by the identical fitment of 2.57 which was applied for pay structure approved by the VI CPC. The recommendations of the VII CPC were accepted by the Government.

Government has recently approved a proposal to establish Armed Forces Special Operations Division which is designed as a tri Services organisation.”

High Court Direction on MSP

On 12th March 2018, question raised by a member in Parliament related to MSP. Whether Government is considering to grant Military Service Pay (MSP) equally to all ranks in the light of Hon’ble High Court’s direction in writ Petition No. 6607/2017 of ‘Voice of Ex-Servicemen Society’?

The concerned Minister replied as follows…
“Hon”ble Delhi High Court in its order dated 28th November, 2017 has not given any specific direction to grant Military Service Pay (MSP) equally to all ranks. It may be informed that the Hon’ble Court in its order mentioned that the conduct of the petitioners in withholding material information and at the same time, trying to invoke equities under Article 226 of the Constitution of India is deprecated.

The 7th Central Pay Commission (CPC) had considered all aspects with regard to applicability of MSP including the rates while making its recommendations. The Government after carefully considering the recommendations of the 7th CPC in respect of MSP has accepted the same and have already been notified.”

7th CPC Recommendation on MSP

7th CPC Report Para 5.2.22 says…
5.2.22 Military Service Pay (MSP): The defence forces personnel, in addition to their pay as per the Matrices above, will be entitled to payment of Military Service Pay for all ranks up to and inclusive of Brigadiers and their equivalents. The Commission recommends an MSP for the four categories of Defence forces personnel at ₹15,500 for the Service Officers, ₹10,800 for Nursing Officers, ₹5,200 for JCO/ORs, and ₹3,600 for Non Combatants (Enrolled) in the Air Force per month. MSP will continue to be reckoned as Basic Pay for purposes of Dearness Allowance, as also in the computation of pension. Military Service Pay will however not be counted for purposes of House Rent Allowance, Composite Transfer Grant and Annual Increment.

17.10 Military Service Pay (MSP): The Defence forces personnel will continue to be entitled to payment of Military Service Pay for all ranks up to and inclusive of Brigadiers and their equivalents. The MSP per month recommended is as follows:

i.  Service Officers ₹15,500
ii.  Nursing Officers ₹10,800
iii.  JCO/ ORs ₹ 5,200
iv. Non Combatants (Enrolled) in the Air Force  ₹ 3,600

Subject: Revision of Pension of Pre-2016 pensioners – Stagnation Increment regarding

The undersigned is directed to say that in pursuance of the decision taken by the Government on the recommendations of the 7th CPC, orders were issued vide this Deptt’s OM of even number dated 12.5.2017 for revision of pension/family pension in respect of pre-2016 pensioners/family pensioners by notionally fixing pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which the Government servant / pensioner retired/died. Concordance tables for fixation of notional pay / pension of pre-2016 pensioners were issued vide this Department’s OM of even number dated 6.7.2017.

2. References/representations have been received in this Department seeking clarification on the applicability of the OM dated 7.9.2016 for the purpose of notional pay fixation and revision of pension of pre-2016 pensioners and family pensioners w.e.f. 1.1.2016. The matter has been examined in consultation with the Ministry of Finance (Department of Expenditure). It is clarified that the benefit of additional increment has been granted to those officers who were serving as on 1.1.2016. Those who retired/died before 1.1.2016 are, therefore, not eligible for increment after retirement for the purpose of pension.

3. This issues with the approval of Department of Expenditure vide their I.D. No.1(3)/V-V/2018 dated 4.9.2018 and 1.D. No.1(3)/V-V/2018 dated 28.11.2018

The matter regarding pay fixation on Grant of Grade Pay of Rs. 5400/- (7th CPC level 9) to Sr. Private Secretary upon completion of 4 years of regular service in the grade pay of Rs. 4800/- was taken up with MoF/DoP&T.

2. In view of the guidelines received from the Ministry, it is clarified that upon completion of four years regular service in Grade pay of 4800 (i.e. Level 8), SPS will be placed in Level 9 corresponding to Grade Pay of Rs.5400 at equal or next available cell. Further, in case the official has been granted Grade Pay of Rs. 5400 between January to June he/she will be granted annual increment of July in that year in the Grade Pay of 4800 and will accordingly be placed under Level 9 at equal or next available cell.

3. An illustration to the above effect is given below for better implementation.

Mr. X promoted to SPS grade in April 2012 is drawing Rs. 53600/- in Level 8 as on 01.01.2016. Upon completion of four years in the Grade Pay of Rs. 4800/-, he becomes eligible for placement in the higher Level 9 corresponding to Grade Pay of Rs.5400/- w.e.f. 04/2016. Since the same cell is not available in level 9, his pay will be fixed at Rs.54700/- i.e. the next available cell under Level 9 and he will continue to draw pay at the same rate upto 30.06.2016. Subsequently, upon pay will be fixed at Rs.55200/- (L-8).

However, as he needs to be placed in Level 9 i.e. higher pay level his pay will be fixed at 56300/- with DNI as 01/07/2017.

Necessary action may be taken accordingly.

Railway Board’s letter No. PC-VIV2016/R-U/35 dated 1910412018 addressed to GS/NFIR

There is widespread disappointment among the OT Assistants/Dressers on Indian Railways as the 7th Central Pay Commission’s recommendation for allotment of entry Grade Pay 2000 (pre-revised) on par with CGHS Hospitals/dispensaries has not yet been implemented w.e.f. 01/01/2016.

NFIR, therefore urges upon the Railway Ministry to take immediate follow up action for obtaining clearance of Ministry of Finance for introducing entry Grade Pay 2000 (pre-revised) in the Dressers/OT Assistants category in Railways with effect from January 1, 2016.

7th Pay Commission Fitment Factor and House Rent Allowance – No Change Therein is Envisaged

In written reply to a question in Rajya Sabha on 11th December 2018 , Minister of State for Finance Shri P.Radhakrishnan said no change in 7th CPC Fitment Factor and House Rent Allowance.

Increase in Pay Fitment Factor and HRA

“The fitment factor for the purpose of fixation of pay in the revised pay structure based on the recommendations of the 7th Central Pay Commission is 2.57 which is uniformly applicable to all categories of employees. As the same is based on the specific and considered recommendations of the 7th Central Pay Commission, no change therein is envisaged.

The Government vide Resolution dated 6th July, 2017 decided that HRA shall be revised to 27%, 18% and 9% of Basic Pay in X, Y and Z cities when Dearness Allowance (DA) crosses 25% and further to 30%, 20% and 10% of Basic Pay in X,Y and Z cities when DA crosses 50%.”

Cabinet approval on 7th CPC House Rent Allowance (28.6.2017) : HRA is currently paid @ 30% for X (population of 50 lakh & above), 20% for Y (5 to 50 lakh) and 10% for Z (below 5 lakh) category of cities. 7th CPC has recommended reduction in the existing rates to 24% for X, 16% for Y and 8% for Z category of cities.

I was promoted to Store Holder on 02-04-2007 and my pay was fixed at
6900/-. But I have opted for fixation of pay in the 6th Pay Commission. In
the year 2011, the post of SH merged with JWM. Now, I am going to opt for
fixation of pay in the 6th Pay Commission from the date of my promotion after
fixation of my pay in the 5th Pay Commission ( at Rs.7450/-). Please tell
what is my next date of increment whether it will be 01-07-2008 or otherwise.

.Sir….does this om serve the purpose for fixation of pay for the
person who have been promoted between 1.1.16 to date of notification for
taking benefit of option 2 i.e. the pay may be fixed on 7cpc scale after
1.7.16 after surrendring the arrear of 7 cpc for the period from 1.1.16 to
1.7.16….plz clarify if anyone has any idea coz i have been deprived of
choosing option 2

.I am working central govt department . Kindly let me know where I
have to submit CEA claim form for the Fin Year 2017-18 of my son studying in
2nd class from private school which not affiliated any board or unrecognized
from any govt body it was in my notice during claiming .Whether I can
eligible to claim CEA for the the said period of financial year. kindly
Suggest me so that I can reclaim my pending children education Allowance.

All is OK in CEA but DOP&T is wrong in explaining the Hostel
Subsidy. In hostel subsidy only lodging and boarding charges are mentioned
and the words and other fees like tuition fees is not mentioned. Hence our
wise Accounts deptt does not allow fees other than boarding & lodging.
Earlier it was mentioned. Please insert the word tuition fees after the words
lodging and boarding. A student is eligible for tuition fees than lodging and
boarding because. DOP&T may issue clarification accordingly..
